Operating Without a License
A company operating without a license can be penalized. If unintentional, PACA requires the company pay the license fees that were not paid while the company was operating. If intentional, back fees, and a fine, may have to be paid. The maximum fines for operating without a license are $1,200 the first day, and $350 for each day thereafter.
If a company is operating without a license because it is not eligible for a license, PACA advises the company to stop operating. If the company continues to operate, PACA can file a case in federal court to obtain an injunction to stop the operation and request a fine against the company or its responsible officials.
