Obtaining a License
Obtaining a license is simple. Fill out the application form and send it to the appropriate regional office with the fee.
The application is signed under penalty of perjury, and there are significant penalties for filing an application with false information.
The application requires persons who are: partners, officers, directors, > 10% shareholders, members and managers in the company, must be named in the application. There are significant liabilities for such persons if the company is found to have violated PACA. These include: restrictions on future employment or licensing; and individual liability for unpaid produce debts. See Responsibly Connected Cases and Individual Liability under The PACA Trust. A person should consider these potential liabilities before agreeing to be named to such positions in a produce company, and contact PACA or an attorney if there are questions about this.
