Licensing Ruses
PACA will not issue a license if it believes the application is a ruse to obtain a license so a restricted person can continue to operate the company.
An example of such a ruse is when a restricted person has a spouse or child obtain a license, but the restricted person continues to run the business in the background. PACA scrutinizes these applications, and sometimes investigates to determine if a restricted person is involved in the business. If PACA finds the restricted person is involved in the business, PACA either denies the license application, or moves to revoke the license if it was already issued.
