The case involved green peanuts. The grower provided 14,000 bushels of green peanuts to a marketer.  The grower claimed the marketer failed to remit the full amount due to the grower.

McCarron & Diess filed a reparation claim on behalf of the grower against the marketer for failing to make full payment to the grower based on the fact that green peanuts were highly perishable.

After providing PACA with sufficient documentation showing that green peanuts were highly perishable, PACA ruled that green peanuts were now a commodity covered under PACA, and the grower received payment.
